ACKNOWLEDGEMENT, WAIVER, RELEASE & INDEMNITY FROM ALL LIABILITY

WARNING: THIS IS A LEGAL DOCUMENT THAT AFFECTS YOUR RIGHTS. PLEASE READ THE ENTIRE DOCUMENT CAREFULLY AND SIGN IT ONLY AFTER YOU ARE SATISFIED THAT YOU UNDERSTAND AND ACCEPT ALL TERMS AND CONDITIONS. ALL PARTICIPANTS MUST ACCEPT THE CONDITIONS THAT ARE SET OUT IN THIS DOCUMENT.

1. I, HEREBY FOREVER RELEASE, INDEMNIFY, WAIVE AND DISCHARGE the Theodore Early Childhood Centre Association (the Event Organiser), any promoters, participants, event organisers, volunteers, sponsors, suppliers, contractors, supporters, community organisations, all state, federal and local government authorities in which the Event may be staged and the owners, licensees or occupiers of any property upon which I enter and their respective officers, directors, employees, independent contractors, sponsors, representatives, agents, members and volunteers, including medical and paramedical personal and any other persons, companies, clubs or associations associated with this event (referred to as “Releasees”) from all liability for any loss, damage, property damage, property theft and all other risks, claims or actions of any kind expense or injury, including death, that I may suffer or that my next of kin may suffer, whether foreseen or unforeseen, as a result of or in connection with, directly or indirectly, my participation in and my traveling to and from the Event including my participation in the Theodore Early Childhood Centre Associations’ Outback Mini Mudder event scheduled to occur on 30th July, 2016 at Theodore, Queensland (referred to as the “Event”), whether it be competing, officiating, observing, working for or for any other purpose or involvement, due to any cause whatsoever including gross negligence, breach of contract, or breach of any statutory or other duty of care.

2.   I understand that the Event may involve travel over uneven terrain, wall climbs, water related activities, kneeling or dragging yourself through mud or along other hard surfaces, and many other difficult and potentially hazardous activities.  I am aware that my participation in this event may have the potential to cause injury (including serious bodily injury, paralysis, drowning, cardiac arrest and death) and also some damage to my property, including shoes, clothing, and anything on my person while participating in the Event. The hazards include, but are not limited to, cuts and scrapes, inclement weather causing cold or hypothermia, death or injury by drowning, heat exhaustion, wildlife, falls from any apparatus, structure or tree, participant or traffic related actions, slips and falls, sunburn, failure or suitability of participant equipment and distance from medical aid, and any naturally occurring incidents.  I judge myself to be fully capable and of sufficient competence to participate safely in the Event and all activities that are sponsored or otherwise presented by the organisers and their affiliates.

3.   I certify that I am of sufficient physical fitness, and that I have received adequate instruction and training to take part and compete in the Event. I also certify that I have not received advice from a qualified medical professional not to participate in the Event and that I have taken every opportunity to prepare myself for the vigorous physical challenges that will arise during the Event.  I acknowledge that I have considered consulting with a medical practitioner to compete in the Event. I have been given the opportunity to attend a pre-event briefing of the course and understand what I am going to undertake.

4.   I certify that the information supplied by me on the entry form is true and correct in every particular and I consent to and authorise that information to be provided to any medical practitioner, ambulance officer or any person involved or associated with any medical treatment or assistance that may be given to me as a result of my participation in the Event, regardless of whether the treatment is given. I give my consent to receive any first aid treatment, and medical treatment which may be deemed advisable in the event accident, injury and/or illness as a result of my involvement in the Event.

5.   I acknowledge that I am completely responsible for all my property and personal possessions during the event, and that the organisers are not responsible for lost or stolen property.

6.   I acknowledge that any photograph or video footage of myself, or any other media relating to the event, remains the property of the Theodore Early Childhood Centre Association and may be used without my consent at any time for any promotional, marketing or any other purpose. I further understand that the Event Organiser, as sole owner, has the full right to sell and/or profit from the commercial use of such recordings or to transfer or assign the rights to use such recordings to any entity without restriction.

7.   I acknowledge that the Event arranged insurance covers public liability and not myself whilst participating in this event. I am responsible for my personal accident insurance and ambulance cover.

8.   I acknowledge that the Event Organiser reserves the right to alter the course if conditions warrant. I agree that the Event Organises reserves the right to cancel the Event due to weather conditions, natural disaster, acts of God, terrorism, war or any other reason so deemed by the Event Organiser, and that my entry fee will be non-refundable.

9.   I agree to follow the rules of the Event as set out by the Event Organiser on the day of the Event and will respect and follow any instruction provided. I agree that if the race stewards or organisers feel that any behavior or action in which I partake breaks any of the rules or brings the Event into disrepute that I can be evicted and my entry forfeited without prejudice. I agree that the organisers also have the right to refuse entry for any reason that they see fit.

10.   I certify that I am not, and on the date of the event will not be, under the influence of alcohol or any drugs, illicit or prescribed, that may impair or in any way affect my ability to safely participate in the Event.

11.   For participants of minority age, I hereby certify that I, as parent/guardian with legal responsibility for this participant of minority age, do consent, agree and accept, to his/her release of all Releasees and all conditions above, and his/her participation in this Event.

12.   I confirm that I have read, understood and agree to all of the above terms and conditions prior to signing this form and do so freely and voluntarily and intend my signature to be complete and unconditional release of all liability due to negligence of the Organisor or the inherent risks of the activity and event, to the greatest extent allowed by law.
